GENERAL BOOKING CONDITIONS

Valid from 15th May 2014

  1.  Terms used:
    1. These conditions apply to all tours and treks provided by Apus Trek Mountain Adventure LLP (“Apus Trek”). Registered in England and Wales No OC388944. Registered Office: 71-75 Shelton Street, London, WC2H 9JQ, UK.
    2. The “Client”, “you” and “your” is all persons named on the booking (including anyone who is added or substituted at a later date) or any of them, as the context requires.
    3. The “lead name” is the person who makes the booking on behalf of everyone traveling on the booking. The lead name must be at least 18 at the time of booking.
    4.  “tour” and “trek” is any expedition, tour, trip or combination of sectors that is described in the brochure or website which you book with us in advance and which we agree to arrange, provide or perform, as applicable, as part of our contract with you.
    5. Website” means www.apustrek.com
    6. “Force majeure” is any event or circumstances which we or the supplier of the service(s) affected could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather or road conditions, fire, bureaucratic obstacles, changes in schedules or mode of transport by ferry companies, airlines, bus or train operators  and all similar events outside our control.
  2. On registering for the tour, passengers accept the General Booking Conditions and Payment Method, as well as the norms, rules and guarantees of Apus Trek described in this document.
  3. Terms of booking treks:
    1.  A contract between us only comes into existence after we receive booking forms, terms and conditions signed by all clients in a group, copies of passports of all clients in a group and 35% deposit and we dispatch, by post or electronically, to the lead name a trek confirmation.
    2. The lead name must be authorised to make the booking on the basis of these booking conditions by all persons listed on the booking (and their parent or guardian for anyone under the age of 18 at the time of booking). The lead name is responsible for making all payments due to us.
    3. In case of any inaccuracies in the trek confirmation, lead person needs to contact us immediately, but not later than 5 days after receipt of the confirmation. We cannot accept any liability if we are notified later.
  4. Payments:
    1. 35% non-refundable deposit is payable upon booking.
    2. Remaining balance payment is required not later than 2 days prior to departure –failure to do so or organise an alternative payment system can result in cancellation of the tour.
  5. Cancellation or changes by you
    1. The lead name must inform us in writing about cancellation. The cancellation charges depend on the time the cancellation notice was received by us:
      1. More than 2 days before start of the trek – 35% charge
      2. 2 or less days before start of the trek – 100% charge
    2. If you want to transfer from one tour to another or transfer your booking to another person, you must inform us in writing together with a completed, signed booking form for the tour to which you wish to transfer. An administration charge of USD 100 per person will be made, plus any other non-recoverable charges or expenses.
  6. Cancellation or changes by us
    1. It is in the nature of a holiday of this kind that arrangements and participants have to be flexible. The day-to-day agenda is taken as aim and not as contractual obligations. It is a necessary condition of your joining any of our treks that you accept this flexibility. It is unlikely that we will have to make any changes to your travel arrangements, but occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will notify you or your travel agent of them at the earliest possible date.
    2. Apus Trek reserves the right to cancel or change any trip due to force majeure. We also reserve the right to cancel any trip due to client unsuitability because of age, ill health, poor fitness, intoxication etc.
    3. Any missed tours due to the above listed incidences cannot be refunded or recuperated.
    4. Apus Trek reserves the right to cancel the passenger’s place on a tour if they have not paid the total sum of the tour 24 hours prior to departure, UNLESS the passenger has made an alternative arrangement with Apus Trek staff in writing.
    5. Apus Trek accepts no responsibility for cases of force majeure or for passengers’ actions.
    6. If we have to cancel your trek due to any other causes than points b) – e) above we will refund the cost of trek in full.
    1. Apus Trek reserves the right to work with other agencies if on certain dates there is not enough people for a group departure.
    2. Responsibility
      1. Your booking is accepted on the understanding that you realise and accept the risks and hazards potentially involved in adventure holidays and that you are mentally and physically capable of undertaking your chosen trip. Please, refer to the ‘Health and fitness requirements’ below.
      2. You are responsible for bringing with you the proper clothing and equipment, which we advise you about in our printed trip information and pre-departure information pack.
      3. If you are unable, or choose not to complete an itinerary outlined for a trek, Apus Trek is not liable to supply alternative itineraries, services or staff for the period when the client is not present with the group.
      4. Apus Trek is liable for the negligence of its employees and suppliers when they are acting in the scope of their employment or in the provision of the trek arrangements.
      5. We are not liable for any failures that occur in the performance of the travel arrangements which are attributable to the consumer, or attributable to a third party unconnected with the provision of the services and unforeseeable or unavoidable, or are due to unusual and unforeseeable circumstances beyond the control of the company which could not have been avoided even if all due care had been exercised.
      6. In the case where damages are caused by you to third parties, all the expenses claimed from Apus Trek that originate from the above-mentioned incident will be charged to you without right to later claims.
      7. Any activities or trips not included within the pre-booked and paid for itinerary are undertaken by the passengers entirely at their own risk.
    3. Health and fitness requirements

    Participants must be in good health and physical condition and are strongly advised to complete a fitness training prior to departure, especially 1-3 days of acclimatisation at high altitude, where necessary. Your acceptance of these booking conditions and payment of a deposit indicate you believe you are of sufficient physical condition to participate in this tour and have satisfied yourself of this through consultation with an appropriate medical professional. Tours take place in remote areas where there is little or no access to normal medical services or hospital facilities for serious problems. Where necessary, evacuation can be prolonged, difficult and expensive. Medical and evacuation expenses will be the responsibility of the Participant, for this reason it is required that you take out appropriate travel insurance. Apus Trek reserves the right in its absolute discretion to refuse a participant the right to participate in a tour on medical or fitness grounds.

    1. Travel insurance

    It is a condition of the trek that you have your own travel insurance prior to trek. Passengers have responsibility to ensure that their travel or medical insurance policy covers the activity or sport in which they are participating. Your insurance must include cover for medical expenses, injury, death, cost of repatriation and evacuation via whatever means necessary including by helicopter/air ambulance. If, in the event of an emergency, medical rescue or evacuation from a trip of the client is necessary, either by foot, helicopter or otherwise, the responsibility for the payment of such costs will lie with the client.

    1. Complaints

    If you have a problem during your holiday, you must inform your tour leader or guide who will endeavour to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to apus@apustrek.com, giving all relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.

    It is strongly suggested that you communicate any complaint to your tour leader without delay and complete a report form whilst on the tour. If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint during your holiday and this may affect your rights under this contract.

    1. You hereby consent and grant permission for Apus Trek to use photos or videos of yourself for the purposes of promoting future Apus Trek programs.
